2021年12月24日全国人民代表大会常务委员会通过了《中华人民共和国科学技术进步法》第二次修订。此次法律修订对现行的科技基本性法律进行了系统、全面地更新，修订涉及的深度、强度和范围都是我国科技立法史上前所未有的。文章通过梳理当前科技立法发展趋势和面临的挑战，系统构建此次法律修订的宏观背景，并在此基础上重点从制度回应、制度创新和实施挑战3个方面对此次修订的重大亮点、重点制度和可能问题予以系统评述，以期为新法律有效实施提供参考。
英文摘要
On December 24, 2021, the Standing Committee of the National People's Congress adopted the second amendment to the Law of the People's Republic of China on Science and Technology Progress. This revision systematically and comprehensively updates the existing basic laws on science and technology, and the depth, strengthen, and scope of this revision are unprecedented in the history of China's science and technology legislation. On this basis, the major highlights, key systems, and possible issues of this amendment are systematically reviewed from three perspectives:institutional response, institutional innovation, and implementation challenge, with designation to providing reference for the effective implementation of the new amendment.

肖尤丹 中国科学院科技战略咨询研究院研究员,中国科学院大学公共政策与管理学院教授。主要研究方向为科技立法与知识产权。近 5年来,出版《开放式创新与知识产权制度研究》《历史视野中的著作权模式确立》《科研机构知识产权管理制度创新研究》《中国科技成果转化制度体系:法律、政策及其实践》等 7部专著。参与《中华人民共和国促进科技成果转化法》《中华人民共和国专利法》《中华人民共和国科学技术进步法》《国防专利条例》《北京市促进科技成果转化条例》及《中国科学院章程》等立法修法工作。

He has participated in the establishment and amendment of laws such as Law of the People's Republic of China on Promoting the Transformation of Scientific & Technological Achievements, Patent Law, Law of the People's Republic of China on Science and Technology Progress, Regulation on National Defense Patent, Beijing's Regulation on Promoting the Transformation of Scientific and Technological Achievements, and Constitution of Chinese Academy of Sciences.
